ON CHIEF JUSTICE ONNOGHEN'S DIRECTIVES FOR SPECIAL COURTS FOR CORRUPTION CASES

President Buhari has once been described by some analysts as the "Foster Child" for Anti- Corruption War. However, with the recent directives given to the "Judges" by the Chief Justice of Nigeria on the establishment of designated Courts for Corruption cases one can safely argue that, in Chief Justice Walter Onnoghen , Anti-Corruption War now has a Team-player. In my view, for the Anti- Corruption war to be fought successfully under Democratic Government the three arms of Government must key into it with all sincerity.

In my suggestion, apart from having Special Courts for corruption cases, we also need a collaboration between the "Judicial" and the "Executive" arms of Government in order to carefully "select" Judges with proven Integrity to head the Courts. Similarly, we also need a "Time- frame " within which Judgement on corruption cases must be passed like in the elections tribunals in order to avoid delay tactics by both the "Judges " and "Lawyers ". To have a " Time- frame on corruption cases, the legislative arm of Government must also key into the Anti- corruption war in order to provide some legislative back up. The legislative arm must not be left out in the war.

In my humble opinion, having Special Courts for Anti- Corruption Trials will go along way in facilitating speedy dispensation of Justice on Corruption cases . Some Judges cite the issues of congestion in the Courts as the reason for slow dispensation of Justice. When President Buhari once said, his biggest headache is the "Judiciary" I understood him so very well, but the long years of Military Rule In Nigeria has made a lot of people to believe that Mr President who is now Democratically elected has powers similar to the powers of Military Head of Head which combine both Executive and Legislative powers with a strong influence on the Judiciary. In reality under Democratic Government is not so!

Some people have "hypocritically " or "ignorantly " often criticized the President over none conviction of corrupt people. They often asked: How many people have been "convicted " so far? Under Democratic Government the President shares powers with the Legislative and Judicial arms of Government. Under the Military Rule an accuse is "guilty" until he proves his innocence, but under our Democratic constitution an accuse is innocent until the law proves him guilty. Under Democratic Constitution it is only the law court that has the power to convict an accuse. 

For we to succeed on the Present Anti- corruption war the three arms of Government must work as a team not at cross purposes as we are currently witnessing. Our Judges and lawyers must be patriotic enough in discharging their duties. Both our Judges and Lawyers must avoid delay tactics. In my view, the National Judicial Council and Nigerian Bar Association must provide a severe sanction on Judges and Lawyers who are employing delay tactics.
